Terms of Sale

Terms of Sale

By bidding at Mebane Antique Auction Gallery (“MAAG”) you agree to be bound by these Terms of Sale as well as the terms of any supplemental notices announced prior to or during the auction start.

All items are sold “as-is, where-is,” with any and all faults, and without guarantees or warranties.

Registration: In order to bid, you must register and acquire a bidder number.  At registration we will require identification, such as a driver’s license, and a valid credit card number.  We reserve the right to charge a nominal amount to your card to establish credit.  In some cases, we may also request a reference letter from your bank applicable to an auction prior to bidding.  For coin auctions and other specialty auctions we reserve the right to request that you instruct your bank to wire funds of an agreed-upon amount into our escrow account prior to the auction (after the sale these funds will be applied either to your balance or returned to your bank, whichever shall apply).

Bidding Increments: MAAG does not have pre-set bid increments.  Bidding increments are at the sole discretion of the auctioneer (the “Auctioneer”) and will advance in any increments the Auctioneer determines as appropriate to the item or items currently on the auction block.

Auctioneer’s Determination Final: A lot will be sold to the highest bidder as determined by the Auctioneer.  It is your responsibility to make sure that the Auctioneer has recognized your bid.  Neither the Auctioneer nor MAAG will be held liable for a missed bid.  In case of a disputed bid, the Auctioneer shall determine who is the successful bidder and at his or her discretion may re-offer and resell the article in dispute.  The Auctioneer may reject small opening bids on high value items.

Condition Reports: If requested, we will provide you with a condition report.  All condition reports reflect our good faith opinion but do not in any event constitute a representation or warranty about an item and are non-binding.

Estimates: MAAG does not as a matter of course establish estimates on any items. Upon request, MAAG may provide you with a non-binding, verbal estimate.

Reserves: Unless expressly stated by the Auctioneer prior to sale, MAAG does not have reserves on any items.

Absentee Bids: If you wish to leave a bid, please let us know by 12:00 PM the day of sale.  We accept absentee bids by phone, e-mail, fax, or in person.  If you fax or e-mail your absentee bid, please call us to confirm receipt.  MAAG is not liable or responsible for any errors or failure to execute an absentee bid.  If you wish to cancel your absentee bid, it is solely your responsibility to notify us prior to the start of the auction.  Absentee / Phone Bid Form.

Phone Bids: If you would like to bid by phone, please let us know by 5:00 PM the day before the auction you wish to participate in.  MAAG is not liable or responsible for any errors or failure to execute a phone bid.  If you change your mind and no longer wish to bid by phone, please notify us of your decision as soon as possible so we will not try to reach you during the auction.

Withdrawal of Property: MAAG reserves the right to withdraw property from sale for any reason, at any time, prior to sale and with no liability whatsoever.

Title: Title to an item immediately transfers from the consignor to the highest bidder when the Auctioneer says “sold.”  Should you be the highest bidder on an item, you are the purchaser of that item and you immediately become party to a binding contract with the consignor (MAAG acts as agent only).  At this point you assume liability for your newly acquired property.

Payment: All payments are due immediately, in full, in U.S. Funds.  Winning bidder is responsible to contact Mebane Antique Auction Gallery. If payment is not received within 3 business days you will forfeit your lots and a UPI strike will be put against you.  We accept cash (in-house bidding/pick-up only), cashier’s check, wire transfers (from only International bidders with an invoice that exceeds $1000 or for gold coins or jewelry purchases), money orders, Visa, MasterCard, American Express, and Discover.  The Buyer’s Premium is part of the purchase price, as is sales tax if applicable.  We reserve the right to hold all goods paid for by check until payment has cleared. Please call the gallery at 919-563-2424 if you have any questions or concerns.

All Gold jewelry and Gold coins purchased must be paid for via certified funds (i.e) certified check or wire transfer.

Sales Tax: We are required to charge North Carolina sales tax at the current rate unless you provide us with a valid resale number at registration.  No sales tax is charged for purchases shipped out of state.  Property picked up at MAAG is subject to North Carolina sales tax, even if you live out-of-state (unless you provide us with a valid resale number). **Coins and currency are tax exempt.

Buyer’s Premium: The Buyer’s Premium is 13%.  It shall be discounted to 10% if you pay by check or cash.  If you plan to have an item shipped to you, a Buyer’s Premium of 20% shall apply, regardless of how you pay.  It is your responsibility to inform us when you pay if you plan to pick-up your items or have them shipped so that we can apply the appropriate Buyer’s Premium.

Storage: MAAG does not charge a storage fee.  You have 30 days after a sale to pick up your items.  At the end of 30 days, we retain the right to re-sell or donate them.

Pick-up: If you choose to pick up your items, we require that you do so within 30 days following the auction.  You must present your receipt in order for us to release your items to you.  This is for your protection.

Returns: All sales are final.  It is your responsibility to inspect an item for condition or authenticity before purchasing it. No refunds are given.
